Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Tourius platform, including its website, mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

1. Purpose and Scope

The Platform provides tools for creating, managing, participating in, and viewing sports or competitive tournaments. These Terms apply to all users of the Platform, including Organizers, Players, and Viewers, across web and mobile environments.

Certain obligations, rights, and limitations apply depending on your role.

2. User Roles

2.1 Organizers

Organizers are users who create and manage tournaments, including player registration, scheduling, results, communications, and payments.

2.2 Players

Players are users who register for and participate in tournaments and may view their personal tournament-related data.

2.3 Viewers

Viewers are users who access publicly available tournament information and may have limited interaction with the Platform.

Role-based obligations automatically apply when a user assumes a specific role.

3. Accounts and Access

Users are responsible for maintaining the confidentiality and security of their account credentials.
You are responsible for all activity occurring under your account.
Certain features require authentication; unauthenticated access is limited to publicly available, read-only content.
You must provide accurate and current information and update it as necessary.
The Platform may restrict or disable access if suspicious, unauthorized, or abusive activity is detected.

4. Organizer Obligations

Organizers are solely responsible for the tournaments they create and manage. This includes, without limitation:

Ensuring the accuracy, completeness, and legality of all tournament data.
Determining player eligibility, rules, formats, scoring, and dispute resolution.
Enforcing tournament rules and communicating with participants.
Complying with all applicable sports regulations, local laws, and governing body requirements.
Paying all applicable platform fees, subscription charges, and payment processing costs.
Indemnifying and holding harmless Tourius from claims, damages, losses, or disputes arising out of tournament operations.

The Platform does not supervise, verify, or control tournament administration.

5. Player Obligations

Players agree to:

Provide accurate and truthful personal and registration information.
Participate lawfully and in a sportsmanlike manner.
Follow tournament rules established by the Organizer.
Acknowledge that all tournament decisions, outcomes, and enforcement actions are made by Organizers, not the Platform.

6. Viewer Limitations

Viewers may access tournament information that has been designated as public by the Organizer.

The Platform is designed to display tournament data in real time or near real time; however, Viewers acknowledge that:

Delays, synchronization issues, or temporary inaccuracies may occur due to network conditions, device limitations, organizer input, or system processing.
Public tournament data is provided for informational purposes and may be updated, corrected, or revised at any time.
Continuous, uninterrupted availability of tournament content is not guaranteed.

Viewers may not interfere with, manipulate, scrape, or misuse the Platform or attempt to disrupt live tournament operations.

7. Content and Data

7.1 User Content

Users retain ownership of content they submit, including tournament data, results, and communications.

7.2 License to Platform

By submitting content, you grant Tourius a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, process, and distribute such content solely for operating and improving the Platform.

7.3 Public Data

Tournament information designated as public may be accessible to any user or visitor.

8. Disclaimers

The Platform is provided on an “as is” and “as available” basis.
Tourius makes no warranties regarding tournament outcomes, scoring accuracy, scheduling, or Organizer decisions.
The Platform does not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law:

Tourius shall not be liable for indirect, incidental, consequential, or punitive damages.
Tourius shall not be liable for disputes between Organizers, Players, or third parties.
Total liability shall be limited to the amount paid by the user to Tourius in the preceding twelve (12) months, or zero if no payment was made.

10. Termination

Tourius may suspend or terminate access at any time for violations of these Terms or applicable law.
Users may stop using the Platform at any time.
Termination does not relieve Organizers of outstanding payment obligations or legal responsibilities.

11. App Store Addenda

If you access the Platform through the Apple App Store or Google Play Store, additional terms may apply. In the event of conflict, these Terms control to the extent permitted by law.

12. Changes to Terms

Tourius may update these Terms from time to time. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Washington, without regard to conflict-of-law principles.
